    I just wanted to add something to this. Not only is Roy P. Snowden and his wife crooks…But they are monsters. Roy and Kim ran a Door to Door traveling sales crew where he worked us kids like dogs and Kept most of our money.Ironicly they let me go for not being honest and left me at a bus station in St. PAul w/ no money and no ticket. Someone should take this evil man off the streets for ever.

    Hi I am just adding on to this last person comment. I worked for a mag sales crew. World Media InternationalInc, RUn by Roy P. Snowden and Kimberly(kim)Snowden,I traveled through your city knocking on doors. Why there is not some protection in place for these kids, more then a randaom story or Blog. This man was just convicted on 5 counts of Tax evasion and defrauding the IRS. I have a tax lean on my credit report from him not filing the taxes he said he was paying!!!! We were kids, and many lives have been Ruined by these people. Freezing cold tempertures and 12-14 hr work days….$15-$20 a day if we were lucky. Then when you don’t make the cut they drop you at a bus station, spit on you and leave eyou w/ no money no ticket, in some ghetto bus station!More, More MOre needs to be done about this. ANd it starts with the people answering the doors. Don’t or if you do tak ethat kid in your house and tell them what is really going on and get them help. These kids are used to make millions of dollars for these dirty old men and thier dirty wives. I pray for the children of these people everyday! I tell you one thing there is no Justice, for these kids.This man has also screwed a bunch of People who were investing in his Java Jo’ z (cuppy’s) Franchise, many people were milked out of 30,000 dollars or more~Any other kids out there who worked for Roy P.     Official Statement from Cuppy’s Coffee & More

    In May 2006, Medina Enterprises, a Nevada based company, purchased the assets of Java Jo’z Coffee & More, LLC, and Emerald Coast Manufacturing Inc. From this transaction, the principle owner of Medina formed an association with another individual, and Cuppy’s Coffee & More, an international coffee franchise, emerged.

    Through this transaction, Cuppy’s Coffee obtained the rights to the logos, assumed the leases and acquired a majority of the equipment. A majority of the former employees of Java Jo’z were offered positions and are now employed at Cuppy’s.

    Java Jo’z still exists as a licensing company and is owned by Kim Snowden. Roy and Kim Snowden have no financial, operational, or legal association with Cuppy’s Coffee.

    Although Cuppy’s Coffee holds no legal obligation to provide marketing, operational, or product support to the Java Jo’z customers, Cuppy’s has chosen to offer these services to the Java Jo’z owners.

    Since August 2006, Cuppy’s Coffee has been inviting any coffee business (including Java Jo’z customers) the opportunity to convert into a Cuppy’s franchise. For conversion details please contact Rudy Harper at rudy@medinamgt.com

    I saw an expose on television years ago (20/20? 60 minutes?) and it was terrible. I can’t believe they haven’t put an end to this. Well, it looks like Roy Snowden could be selling magazines on Cell Block C for quite a while. He is due to be sentenced at the end of this month. Some fellow Snowden and Java Jo’z fans are submitting sentencing recommendations. Their website is at http://mooresinflorida.blogspot.com.

    Have you considered starting a blog to expose this scam? Some exposure in myspace and facebook could help keep some other kids from falling into the same situation. Just a thought.

    Yes, thanks to you and the owner of the bluemaumau.org site for writing about the similarities between the two companies. My brother also got one of their legal nastygrams, so we, at the time, decided to pull all references to Cuppy’s out of our blogs.

    But, thanks to your posts, the posts on bluemaumau.org and some legal advice given to my brother, Ben, I decided it was time to highlight the fact that these two franchisers are indeed very similar companies. Even pointed to your blog and bluemaumau.org’s postings.

    So thanks for the support in this. I just hope that it gives people pause when thinking about doing business with Cuppy’s and also gets my brother and his partner (not to mention the other people who have also apparently been similarly shafted) their money back.

    Sean Kelly previously requested some information from Cuppy’s about how we process Java Jo’z conversions. I emailed him on January 17, 2007 with a response; however, he has chosen not to post it. We have provided this goodwill offer since June of 2007. My email to Sean Kelly was as follows:

    Mr. Kelly:

    When we receive notice of a Java Jo’z licensee or anyone with an already existing concept desiring to convert to our franchise system, the terms of the conversion are negotiated individually. We disclose the Cuppy’s UFOC and ask them to enter into a Cuppy’s Franchise Agreement. Generally, if a Java Jo’z licensee has already paid funds for a deposit, we try to recognize their payment so that double-payments do not occur. For those that have not already found a site, we offer our assistance with site selection, including our connections with national real estate brokering companies and malls. Essentially, we attempt to effect these conversions so that the overall investment is similar for converting units and those that originate as a Cuppy’s, but as circumstances differ in every scenario, these terms may differ as well. Please advise if I can assist you further.

    It’s puzzling as to why Cuppy’s is being so defensive about this issue. If they are willing to honor the deposits made to Java Jo’z, as this message seems to indicate, it’s a generous gesture. Why not just come out and state it clearly?

    Cuppy’s and Java Jo’z
    Ok well it seems the whole Cuppy’s / Java Jo’z world is going mad. How a company trying to avoid some much deserved bad press can go around deleting and rerouting url from blogs and legit web sites! I have been following all of this very closley mainly because I randomly Googled ROY Snowden , World Media International and Magazine sales crews, When I stumbled upon all this stuff going on with this man. I can not say that I was at all surprised. When working for him on the Mag crew I seen just how rotten and slimey he could be! Now all of these peoples lives are being negitivley impacted by his shaddy dealings. I personaly do not know why he is not being sued and / or investigated on all of these other alligations. Just goes to show you how our goverment spends its time chasing all the wrong criminals. This man should have ben in jail years ago.

    So now Cuppy’s / Java Jo’z/ Medina Enterprises are going around and deleting all the negitive comments about them. Listen, these people bought a company from a convicted criminal, who they knew was involved in these shady practices. Roy Snowdens “friend” and ex partner is now part of this Cuppy’s but they say they have no affiliation w/ Java Jo’z or Roy Snowden and Kim Snowden. First of all hacking is illegal. Second how stupid do these people think the public are. I find it utterly humorus the comments and bloggs the “employee’s” are writing about this company….Hmmmm…all this brain washing sounds very familiar. Doesn’t it Roy. ANd the people who use to work for them and are blogging the truth they are dogging.

    Only as an adult have I truly realized that there are people out there who do not have an honest bone in there body, some people are so obsessed w/ the love of money and lifestyle that they will trample on anyone to get it. I tink all of these people Roy Snowden, Kim Snowden, Ben Doyle, Medina Enterprises , Cuppy’s , Java Jo’z need to be further investigated.

    Also this man who started all the Buzz about the scam and losing of money’s has dissapeared from the net. Either scared by a letter from the lawyers of these cowards threatning a law suite or quite possibly bought off. This country was founded on free speach and If this Ben Scoble is not a dunce he knows he can say anything he believes to be true in any forum he wants.

    I am quite disgusted by this whole thing, I hope they all get what they deserve.
    I personally feel what ever you put out there comes back to you ten fold!!! And when I was a scared 19 year old in a bus station in the ghetto of St. PAul w/ no mOney or bus ticket i prayed this man would someday get his. I can only hope that all of this bites him in the ass, “law of averages” says you can’t get away with everything forever.!

    I am so really extremly shocked to see all of the post on the matter I discussed earlier are gone. Everything I have posted on this matter has been deleted. Someone tell me there has got to be something I can do about this. Cuppy’s is/ has to be breaking some law by deleting these post and redirecting URL’s. I fully plan to look into this, I spoke to the IT guy At work today and he says it is a break of federal law. That these people seem to just be getting themselves into more trouble. This really has my attention now. And anyone interested in free speach or even the gift we have been given to blog our thoughts and opinions should be deeply concerned by this company’s obviouse attempt at silencing it’s criticts. I can not believe that any lawyer representing this company would give them this advice. I know one thing I am not Scoble , I will set up a 1000 different blogs and let them delete them so that I can sue. Not for money but principal. How dare they think they have some power over the internet.

    It astounds me to read posts from people that think thatany company, especially a small coffee company, has the skills to go around hacking websites and redirecting URLs. These people have been watching too many movies. I am a former Cisco Engineer, and I can’t believe that these things are happening. All of these posts show no evidence of these things. If the posts on people blogs have been removed, it had to be done by the owners and managers of the site. I am sure that Scoble could post blogs faster than they could be deleted if he chose to. I feel bad for him if he got involved with Java Jo’z without reading the contract. But, that is why we all have access to attorneys. If he really has a claim, he should get an attorney and sue, if not, quit crying.

    It’s official! Java Jo’z Chief Joe, Roy Snowden, was sentenced to four years in prison and three years of supervised release for Evasion of Payment of Income Tax and Conspiracy to Defraud the IRS. In the end, Snowden admitted that he failed to file tax returns and set up companies to transfer assets to escape the reach of the IRS. But it seems the IRS has long arms.

    It was Sean Kelly and Franchise Best that helped bring to light the story of Java Jo’z and Cuppy’s Coffee.

    what a sleazeball. And Ben Doyle is not any better. I live in Ft Walton Beach. I was opening a business and needed a building. One thing led to another and I was introduced to Roy who built my building, which is the first K3 he built. He promissed it within one month. It took him 6 and I think if it were not for the fact that I am local I would still be waiting. He has some psych issues. Would come to my business and piss and moan and act as if he owned the place and was really shaky at times and looked as if he was on drugs.

    His wife reportedly has some issues as well and I always felt sorry for her but wondered her level of involvement. So with Roy’s delays, and my constant badgering, he cost us all of our capital. He promissed to sell some franchises for us. We sent him names of people who constantly complained about how rude they were.

    Roy had a thing for my wife and made her really uncomfortable. He even offerred her a million bucks, no kidding , to leave me and bring the store with. He came in alone all the time to proposition her. I recorded a lot of this. We ended up telling him we would get restraining orders against him and give Kim the tapes. He tried to sue us after that for some made up crap. It was thrown out. He usually had three or four lawsuits going. I hope he has to pay everyone back and spends more than 4 years in the pen. He has a house that has increased in value and is worth a couple of million bucks, I hope they seize that if they have not already.

    Yup…sounds like the same ROY we all know and love…FYI he was sentenced to four years…in Federal Pen…# yrs probation and has to pay 1.16 million….They say he has already paid-GET THIS 900,000.00 hmmm wonder where that came from….

    I WOULD NOT EVER IN MY LIFETIME THINK OF EVER GOING TO LET ALONE PURCHASE A FRANCHISE FROM “RITA’S WATER ICE”. WHAT HAPPENED TO MY GRANCHILDREN ON WEDNESDAY MARCH 21ST (1ST DAY OF SPRING) IS UNFORGIVABLE AND I WILL DO EVERYTHING IN MY POWER TO BOYCOTT THIS FRANCHISE.

I understand that most of the conversatio here is based on the Cuppy’s/Java Jo’z scandal. But Roy is also in prison due to tax evasion and IRS fraud issues, correct?     It is just as important for someone like Trisha to voive her oppinion as it is for the rest of you. You all may be involved a little more on a professional level and feel that because you may be directly related to the coffee end of the scandal, that your oppinions here are more valid. You are adults who probably make rational decisions and you were still taken for a ride by this guy. Trisha was a child when he manipulated her and so was I. And….so were hundreds of other children as young between 16 and 20 years old…..and so were hundreds of thousands of folks who bought or renewed magazine subscriptions from these kids at their doorstep, perhapse paid in cash and never recieved one issue of the magazine and no doubt never saw the $40 to $80 again. Maybe this is not the place to be bringing this up. But its definitely not your right to tell Trisha to take it somewhere else. If you people heard her story and stories from hundreds of other children (or the parents of these kids) 5 or 10 years ago it may have helped you to make different and better decisions regarding your trusting your investments with this man. If you had known me, and my story, you would have asked different questions and maybe taken your business elsewhere. What happened to us on the magazine crew is relevant because it shows a cycle and a trend of how this man operates. Falsley advertising in local newspapers directed at appealing to kids. Liying to them about the expectations of the job when you hire them. Bussing them from there home in Seattle to Escondito, CA where they pack 4 to 7 kids per room in ratty, shabby, filthy hotels in ghetto-esque neighborhoods. Bussing them around these same neighborhoods and dropping them off, alone, for hours at a time with no phone or possible way to call for help if something should happen to them or if they should get lost. Only allowing them 2 meals a day, one very early and one very very late. Requiring them to work 6 or 7 hours a day from 8am until they got there ‘quota’, often times keeping them out in crime ridden neighborhoods long after dark knocking on strangers doors asking for money for magazines at 11pm or later. At the popular chance that one did not get their ‘quota’ there was punishment. You might go hungry, you might sleep on the floor or worse, you might be physically harmed during a fit of rage in one of Roys temper tantrums. I can tell you about a time where I had raised some eyebrows in the group and caused negativity because I complained when I was not allowed to visit my family for my birthday. A meeting was called for the entire crew and in Roys rage he picked up an adding machine and sent it flying accross the room, landing against a wall inches from my 19 year old head. After that, it was thought that I might try to leave the crew so I was not given my 15$ a day money to eat for the next few weeks and was forced to borrow or share from other kids. My phone card given to me by my mother was taken from me. I was threatened that if I left I would owe thousands of dollars for my hotel accomodations for the last several months, though I had made thousands of thousands of dollars for Roy that I never saw a penny of. Tell me that my oppinion on the man does not matter. Tell me I cant voice it here. He was lying, cheating and stealing long before this story became public conversation. The difference is, at that time he was lying cheating and stealing from your children or your grandchildren.

    I for one am happy to see him get what he deserves. To bad Kim is not getting hers as well. I give props to Trish for standing up for herself here.

    I have said from the beginning this was not about me being a part of the franchise…But As J. Gleason points out this man and His wife have a track record…the Jail time he is doing is because of hiding his ASSETS of WORLD MEDIA INTERNATIONAL INC… and the money he made during 4-5 years of that buisness—- I am sorry that the taste left in my mouth by this man is still bitter….Excuse the Pun… To say that the only ones important here are those that Lost 30,000 from the Java JO’z….Is Ignorant….I wish I could tell you how much money the man owes me and thousands of other kids and MAGAZINE customers. I have every right to comment on this and back up the anger that these other people are, that were screwed by ROY P SNOWDEN and KIM SNOWDEN.

    The fact I am dead or kidnapped after being left in the Ghetto of ST.paul w/ no money or way home….TO RI….at 19 years old shows the reason for my bitterness….anger …and complete satisfaction in his imprisonment.

    I totally understand all of the comments in this blog. My wife and I purchased a Java Jo’z franchise, only to be totally pushed away when the company became a Cuppy’s. Only because we were about to lose our $50,000 initial investment we decided to switch to the Cuppys. This new company Cuppys is not much better than the Java joz. The company continues not to provide the services or the equipment that has been promised in the contract when we purchased the franchise. It has only been through our constant persistant and hard effort that we have almost gotten our store completed. The contractors that Cuppys hires to do the work are totally unethical and at every turn Cuppys or the contractors try to delete or supply a lesser quality item than what is in the contract. Cuppys also continues to come up with items that are in the contract but Cuppys says it is the owners responsibility to install. It would be my suggestion that everyone stay away from this franchise unless you have plenty of extra money to spend.

    Robert your experience is so close to ours, we want you to know that you are not alone. We should get with everyone involved and try a class action lawsuit.

    We are almost finished with our store as well but thank God they lost our contract so we are no longer Cuppys. But they are still obligated to complete my store and believe me they are kicking and screaming. We must warn everybody out there do not do business with thse people. By the way the man who started complaining about Cuppy’s in the first place now works for them.

    Yeah!! We bought into the whole Java/Cuppy’s thing, now we are fighting to get our $30k back from these theives. I had one of the employees tell me on the phone, “Mrs. Rivera this is a corporation do you think we keep your money in the back room, we have bills to pay, your money is gone”. Of course I didn’t like that response so I told her I would be getting a lawyer and the response was good luck with that. All I can say is I am glad we were not in the building stage and lost more than 30K, we could be like the other Java Jo’z in my town which is haveing TONS of problems with the building, their service etc. She is fixing to lose everything because of the delays and broken items, lack of business, you get the idea. What goes around comes around. I don’t care if they say they are not the same, they are, the same person who took my money at Java Jo’z is the same person who will not give it back at Cuppy’s. That’s ok I’ll get my money one way or another and people will know what type of company this is.
    BEWARE TO THOSE WHO MIGHT BE TRYING TO GET IN!! RUN!!!!

    Well, as with many of you who are Java Joz owners or are in the process,my experience has been for the most part quite disappointing to say the least. Right now I am trying to settle with these people down in Florida and they refuse to respond to any of our letters. The lawyer that represents the who company has since placed a lien on my store. They say that we owe them money. Well on the contrary, many of the items that we were suppose to recieve we didnt. The contractor on the job was so slow if he went any slower he would be going backwards. My signage was late…etc…

    Then there are the people who try to get they’re money back and the Snowdens state that if these people sue,then they will just claim bankrupcy. Isnt that convienent!

    In my personal opinion this whole process has been shady to say the least. Sure, Cuppys offered to change Java Joz investors over to Cuppys at no price. If you think about it, the reason many of us wanted to be licenses is because we didnt want big brother telling us what we could sell and how to sell it.

    There is no way the Morgan couldnt of known what Snowden was doing. When he pulled out the tape recorded during our meeting I should of turned around and went back home. But I didnt. Now look at the mess I am in. Please think twice before you do business with these people. There are many other companies out there that are established and up and running in good form.

    This restaurant is an incredible concept and will work nation-wide. Grilled Subs, Toasted Subs, Cold Subs, Wraps & Pockets…they offer something for everyone. I met with the folks at USA Subs…or rather American Dream Franchising and they answered all of my questions. If I can get the financing…I’m going to open up my own franchise. I had never heard of them until the articles about the “Steak Bomb Controversy” and think it was a publicity stunt to garner presss…well it worked! When I drove by they were packed. Then when we met at the Derry store they were packed again. I can see why their sales volume blows the competition away.

    I can’t believe I didn’t find this sooner. While doing a quick search for Roy I can upon this bash fest with little delight. First lets start things of by saying that I am amazed that “J” can even spell much less read enough to try to stick up for a lier. It would be one thing if her story was strait but it is in fact, fictional! She was caught stealing or “not giving the customers receipts and keeping the money for herself” and then was given another chance by Roy to stay on and do the right thing. But alas she could not help herself and continued about her ways. And if-so-facto she was “let go” in Fargo, N.D. at a Greyhound Station with ticket in hand.

    Now as for “J”. There are “mag crews” that are like you describe but the one Roy P. ran was nothing as you describe. Yes some did have bad experiences but those where mostly people who didn’t give a shit about anything and where treated like wise. W.A.B. I believe was the term used most for people who couldn’t swing the d to d sales b.s. and you sound very much like one of those people. I happen to work for this man for two years, I stayed in one hotel that wasn’t the greatest and yes sometimes I didn’t meet my quota but never did Roy treat me with anything but respect as I him. I guess my point here is you get what you give.

    Sometimes karma is quick and sometimes it can take years.

    P.S. Kim went crazy and was institutionalized some years back so I doubt she had anything to do with this.

    This article is very important. And its absolutely true regarding many franchises especially Pirtek. The statistics are produced by the franchisor. If a franchise fails in, lets say, Mobile, AL. and a new owner takes over in a process known as “refranchising” then the record only shows a resale or maybe the record shows nothing, but the truth is the first owner failed and now with a new infusion of cash and a new owner the life expectancy of a franchise at the same location is recorded as a success rather than a second franchise. If you are seriously thinking about buying any franchise “system”, just take your best estimate of start-up capital required and double it. That much fear and that much cash will get you past 5 years. The best businesses are not franchised, IMHO. Feel free to contact me if you have any questions.     By the way Steve “H”, if i remember correctly you had your fair share of issues, as we all did. You are very ignorant to be sticking up for ROY when it is clear what kind of man he is, he is sitting in Federal Prison.(I am not) I mean it’s not like people are just making up all tis stuff about him.

    The man made millions of dollars off kids, paying them 15.00 a day to eat and do whatever else they needed.(BTW he is in jail for tax freud relevent to the mag crew buisiness.) The hours worked, the brainwashing, I mean this man has never looked out for anyone but himself.

    He also took these peoples money and lived a lavish life style BY BEING DISHONEST. A little bit of pot calling kettle black, don’t cha think.

    I see the brainwashing stuck w/ you. I did chose to go and sell these magazines, I did chose to go back, but I was a nieve kid, and thats what these people count on.

    Any amount of research will show everyone involved in these mag crews (upper management) are shady, too slimy to make it in the real buisness world, which requires dealing with smart , savy buisness people.

    Therefore they involve themselves in a buisness, that requires little more intelligence then brainwashing kids, and living off of thier hard work.

    I on the other hand left crew, went back to school and work in the financial industry, where I am no longer nieve, nore deal w/ slimly, lowlife, selfish, small minded mag crew “managers”.

    Yes Java Jo’z and Cuppy’s are separate companies BUT- took over all the same lame people that do not know how to serve franchisees! I visited the Corporate Office, and talk about unprofessional. They wanted me to sign a contract that day. The whole company is a scam and if you are looking into their franchise beware- oh I also saw their wonderful high rating from The AAFD- well new owner of Cuppy’s stated they did not live up to the AAFD standards at all, so they should not have that award by any means. Beware of all the scams!!!!!!!!!!!!!!!!

    I read recently that dog walkers and I assume pet sitters in general will be required to have licenses. Part of the licensing procedures will require law enforcement training so that dog walkers may help keep an eye on local environments while performing their trade. I thought this was a very interesting concept.

I thought this was a very interesting concept and a good idea. This would entail them having to carry additional items such as cameras, note pads, binoculars, etc …

    The SmartWalk Manager can be seen as a “tool of the trade” for dog walkers and therefore may be tax deductible. Check with your tax consultant for details.

    I think this article is very good. I think the interview is very telling, “18 franchisees who own 97 bakeries” . This shows that Bruegger’s bakeries partners with committed, experienced savy franchisee/owners that know this business, and I would suspect have the capital to weather business swings. I am sure this business is competitive, but it seems very smart and very efficient to have 18 highly motivated franchisees work together and grow Bruegger’s bakeries. Many franchisors have a difficult time growing because they have to refranchise or constantly get new blood and cash to act like they are growing. Pirtek has only a few franchisees with multiple locations, franchisors like Pirtek grow very slowly, and face litigation issues, and are constantly scratching for new franchisees. Bruegger’s bakeries concentrates on growth from within and wins, while other less focused systems use a shot gun approach to grow, creating only a few winners, and lots of losers. I think Bruegger’s bakeries has a great approach in regards to franchisee retention and overall growth.

    I am very happy to be a Pirtek Franchise owner in Plano, TX for the last 3 years. I have struggled a little bit in this economy, like everyone else, but I am proud to report that my business has increased significantly over the last 12 months while I have watched several businesses close. Pirtek has over 300 Centers in operation around the world and is number 1 in the world and number 1 in the U.S. in mobile hose replacement.

    The bottom line is that Scott failed and I believe he wants everyone else to fail just like he did.

    The Pirtek System is not for everyone. It requires hard work and diligence, just like any business. However, if you follow the Pirtek System and grow your business like 300 other franchisees around the world have, the rewards can be very big! That’s why 6 of the Pirtek owners in the United States own more than 1 Center and some have signed on for a third Center.     I was a java jo’z franchisee. I to was ripped off of 30,000. I was receiving quarterly disbursments from a law firm handling the java jo’z settlement. We also had trouble finding a site. That law firm is no longer sending the disbursment out. I received a letter, but lost it about a new firm handling the quarterly payments. Question: Anyone knows how to contact or has contacts to see why the payments stopped. We settled on 27,000 to be refunded and about 4,500 hundred has already. Please call me at 504 259-4520.     Mr. Johnsons post is inappropriate. The BRUEGGER’S BAGEL’S interview above discusses issues of transparency. BRUEGGER’S BAGEL’S want each franchisee candidate to have a very good idea of what it is like to be a franchisee. This is smart business, it shows that BRUEGGER’S BAGEL’S is open to observation before a purchase.
    Pirtek on the other hand offers little or no transparency. Mr. Johnson fails to mention the numerous closed Pirtek locations, he fails to mention his low profits, low sales growth, but he does say its been a struggle. Mr. Johnson fails to mention that there is maybe one company owned Pirtek location, while Bruegger’s notes 177 company owned stores.
    Pirtek franchises cost just as much as Bruegger’s, yet Pirtek has only 38 locations and 90% are owned by ONE franchisee. Pirtek has been franchising for many years with poor results, plagued by numerous Terminations, closures, and Bankruptcies. Mr. Johnson fails to mention the 24/7/365 nature of emergency mobile hose repair, the late night calls, and high employee turn over. There is a reason 90% of Pirtek locations are single unit operations while Bruegger’s has 97 bakeries owned by 18 franchisees. A good business model allows for a franchisee to grow and buy more locations, this can only be done with healthy cash flow and profits and a system that allows for off- site owner management.
    Pirtek offers little more than buying yourself a job, an expensive, high risk, low paying job. Bruegger’s on the otherhand seems to be a much better place to be a franchisee. Have a great day! Scott Layer

    In my experience, choosing the right franchisees and making sure they have the right expectations are critical to the success of young and upcoming franchise systems like Cool Cycles. Franchisors are responsible for providing the tools, but franchisees need to understand, from the start, that it’s their responsibility to build the business in their local market.

    This is a perfect example of a franchisor engaged in the practice of just selling franchises. Franchising, in its purest sense, is a market penetration strategy just the same as if the company were opening their own locations. Would they open a location just for the sale of opening a location and risk it closing? Probably not.

    However, this franchisor is simply collecting fees.

    This person is a perfect mismatched franchisee. If the franchisor had bench-marked who their high performers are and why and then recruited and selected candidates who resemble this profile they would be able to build a solid system comprised of the right people performing the right functions in the right franchise.

    Sears just gave Franchise Navigator a wonderful testimonial that indicated the Franchise Navigator, through recruiting the right people into their Hometown Store concept, increased their average unit sales 38% and almost eliminated their budget to resolve conflict.. This is an amazing testimony to having the right people in the right franchise.

    After almost 40 years of franchising my opinion, and I have been quoted in the media as saying this, there is no such thing as a good or bad franchisee. There are franchisees that match and those that mismatch with the business model.

    Legitimate franchisors are the ones who carefully profile their existing franchisee population and using their own performance metrics create a standard for which all inbound candidates are measured to.

    The others are probably going to go away and take many unfortunate people, such as Jenny, with them.

    To me that is not representational of franchising. To me that is criminal.behavior.

    Franchisees can avoid the devastating mismatch by using a franchise professional (like Joel) who will spend some time with them and steer them away from opportunities that they are clearly unsuited for. Unfortunately, many who claim they provide that service are really just salesmen who will recommend whichever opportunity yields the quickest commission.

    Franchisors can avoid the mismatch by deploying services and tools like Craig’s that evaluate the types of people most likely to succeed as franchisees.

    Good thought, Craig: “there is no such thing as a good or bad franchisee. There are franchisees that match and those that mismatch with the business model.”

    Great article. Great storytelling. Congratulations.
    I see a few breakdowns.
    1. The franchisee did not have a clear understanding of what it takes to win. This was the franchise candidate’s breakdown. Candidates need to conduct proper due diligence. With all that is written about how to research a franchise (my book Street Smart Franchising is one out of 100 active titles) the franchise candidate cannot plead ignorance.
    2. The franchisor didn’t either properly communicate what it takes or didn’t check in to see what the franchisee thought. This is often what happens when you have a franchisor who “sells franchises” rather than one who carefully screens and educates candidates. The franchisor apparently lacks one or more of three things.
    One, a step-by-step recruitment process to educate candidate about the company and opportunity
    Two, franchise salespeople who have not been effectively trained as recruiters
    Three, poor departmental leadership. No one watching out for the franchisor’s candidates best interest.

    This is a highly avoidable lose/lose situation.

    Having been a franchisee, an independent business owner and twice part of franchisor teams, I should be able to accept this sort of situation as normal and not be surprised by it Yes, to those uninitiated readers who currently find yourselves in a state of disbelief: Sean has recounted a frighteningly NORMAL situation. Yet, despite all the failure I have seen, I am still astounded by the efficiency with which business owners can create massive black holes into which they throw their money.

    Even beyond the great points made above (I’m a fan of Joe’s book and Craig’s evaluation tools, which I’ve used) I believe that the fundamental issue here is one of denial. The franchisor and the franchisee are both guilty of it.

    I have zero doubt that there were red flags along the way by both parties. I have zero doubt that SOMEONE at the franchisor questioned signing the candidate and I have zero doubt that the franchisee did hear a thing or two about marketing, and that despite owning the RIGHTS to run a print shop, she knew she had no right to print money. None of that will stop people from being lazy, believing what they want to and regressing to the mean.

    As was mentioned above, no one would dream of opening a corporate store only to watch it fail. Likewise, no independent business owner would set up shop, and proceed to do nothing. What is this disease in franchising?

    Yes, I do think it’s denial. There is so much regulation and so many processes, even rituals that surround franchising, in some way, it must feel to all parties involved that by following all the rules and walking through the steps that they are conjuring real businesses. In fact, they are doing nothing more than signing papers.

    I, for one, am a fan of franchising models that more closely link franchisor and franchisee success, which eliminate the “in name only” problems and get everyone really working together.

    This should be an interesting series, Sean. I’m looking forward to your future posts.

    Sean…the first emotion that comes up for me when I read about Jenny is sadness.

    There is no question both franchisee and franchisor are suffering in this case, and needlessly so. All of the comments made thus far offer good explanation for what could have been done and what should have been done. Let me go a bit further with what still can be done.

    I have been fortunate this past year to work side by side with new franchisees of a well-reputed franchise company. The franchisees were selected by their franchise business consultants as those that could benefit from individualized business/sales coaching with an outside provider.

    As that provider, I spent a minimum of 3 months with each new franchisee. I worked closely with the franchisee’s business consultant so that we were talking the same language and supporting one another’s goals.

    With the franchisee, I worked hard to build trust quickly. This enabled the franchisee to become open to new ideas about selling themselves and their products and services.

    In almost all cases, the franchisee was uncomfortable with sales and marketing.

    Why? Because most people have very negative feelings about selling. They think back to their own poor experiences with salespeople and don’t want to be seen as manipulative or confrontative.

    Once I show them that there is a kinder and gentler way to sell…and a way to sell that is congruent with their personality style and strengths….they breathe a sigh of relief.

    I typically send them a copy of my relationship-selling book, Stop Selling: Start Clicking!, so that they have a resource to refer to in the space between our calls.

    In all cases, revenue growth is our #1 goal. We co-create sales and marketing action steps that they are comfortable with so that they can see a quick result.

    Once their confidence is raised a bit, they are open to even bigger ideas.

    Sometimes franchisors just don’t have the man/woman power to give each franchisee such individual attention. In these cases, an experienced outside provider can really make a difference.

    I congratulate this franchise company and all companies that look outside of the norm for ways to increase franchisees’ comfort level with sales and marketing.

    Nothing is better than seeing a franchisee make that all-important turn in the road.
    The results are increased confidence, stronger skills, and in turn, higher revenue.

    How lucky are we to all be playing on the same team!

    I agree with Craig. This is more than likely a case of a franchisor simply seeing dollar signs and taking on any franchisee. The only other scenario is that Jenny fooled them all. Similar to when someone is great at interviewing and lands the job, but then performs poorly. Or, Jenny is a good candidate and the franchisor dropped the ball during the new franchisee training. Many franchisors wrongly assume franchisees know about sales and marketing or ever that they actually have to (gasp) get out there and sell and not just hang up the ‘open’ sign. We’ve worked with huge systems with 1,000’s of rooftops and they many times have very poor training when it comes to sales, marketing and motivation. A lesson for us all… never assume a franchisee knows anything! Sounds harsh but you will end up covering all the bases.

    More than a few of those who commented share the mixed experience that I have been fortunate to live over the last twenty-eight years within franchising. I have been franchisee employee, franchisee, executive within a franchise and consultant into the franchise industry. I have had the good fortune to work with the consumer to determine their best franchise fit and with franchises to determine their “right” profile; the person who would become their next successful franchisee.

    Wouldn’t it be great to read this snippet and to know what in the world this is all about?

    But, we can’t. This isn’t enough…

    I can see and agree that the franchise company missed something in the selection of this candidate. Craig may very well be right and this particular franchise might be simply sniffing for franchise fees.

    But, in my experience it is just as likely that they got a great interview. We have all had one or ten of these kinds of candidates. They feel they are on a job interview and they are really great at giving up the right information. They would especially be good at it if they REALLY wanted it (think 4 year old, holding a toy, in the middle of the aisle at Toys R’ Us, screaming, “I WANT IT! I WANT IT! IT’S MINE!”) and prepped by saying the right things and knowing the right answers.

    No one associated with any form of business, small business, independent business, mid-sized corporation, big business amongst the redwoods of Fortune 500 companies could miss that the “zee” herself must be sniffing too much ozone for thinking pixie dust had been sprinkled on her business and she would simply await the teaming masses who would be transported to her doors with life-giving work; profits to follow.

    I owned printshops, franchised printshops for fifteen years. To this day some close friends still do and are great friends who succeed and compete in that industry…and it can be tough and competitive and challenging and no easier today than when I sold the last of mine successfully thirteen years ago.

    But c’mon…no one in that industry for 11 minutes thinks you can sit and wait in your office on an old couch you once used in your family room and the work will walk in the door.

    Flo is right on the manpower issue. Mike Sobol is right that this kind of scene, where the franchisee has simply been overwhelmed at the task at hand, now exists in a gray fog. Everyone who hinted that the franchisee should be ashamed at the obvious oxymoron of sitting on your can and blaming the franchise company is beyond ludicrous. And Joe Mathews, whom I respect deeply, makes a great point; the tools are there in order to avoid this scenario…and not just for franchise companies (though they should take the lead) but also for franchise candidates.

    I urge the franchise consulting firms to truly come up with the right tools to “REALLY” profile their candidates. Many people simply are not, nor should they be at this time in their business development maturity franchisee’s…period! Not just with the wrong franchise…but at all! Find THAT out first and then make sure that the instruments you use don’t merely measure personality type or leadership type but those things that create the foundation for success internally within an individual or organization. This is no small task but, as Joe Mathews alludes to, it is doable with all we know and all we can determine in the twenty-first century.

    Mike Sobol is right. The franchisee knew the right thing to do. She had been taught about marketing. He was also right when he said someone raised a red flag when it came time to select this candidate only to be treated like an adult in a Peanuts television special. It is easy to say and think that we (the franchise company) can get a new franchisee “over the hurdle” in training.

    Finally, as a pastor and professional counselor I have to chime in as well to say that there is no accounting for the places humans find themselves. Our journey’s are not constantly up and away! The adequate and competent and consummate professional one day becomes roadkill in the sea of life the next. We just don’t know what stymies or even puts someone else into a tailspin the next day. That is why it is important to see your franchise organization as a living, vibrant organism. Thinking of it as simply a more well oiled production tool today than it was yesterday focuses you away on the human element. And it is this element that makes us better, stronger, richer in character and creativity and more prepared to take on the challenges of today. But it is sensitive. It is fragile. It needs care. Make sure you have operations, marketing, training and executives who care for the whole body and thereby detect when one part of it isn’t producing what it should.

    When I work with organizations I take from my background in pastoral and counseling leadership and I add to it my business acumen. If I can be of service to anyone, in any business unit, whether it is with your franchisees to “generally” market, sell, produce or with the franchise corporation to understand/discover who they are and what they need…it would be my honor to serve you.     Yes, the franchisor could have and should have done a better job of selecting. They should never have accepted Jenny as a franchisee. They could have avoided this right at the beginning by stressing the heavy marketing/sales responsibility during the first interview and suggested you talk to other franchisees about what they have to do on a daily basis.

    In an ideal world, franchisors would live their words about “awarding” rather than selling franchises, but realistically, many franchise sales people are under a lot of pressure to lower their standards. Whether times are good or bad, many franchisors use a business model that depends on the franchise fee to meet operational expenses. Of course doing so is a very short-sighted approach to selection, but it meets today’s financial needs.

    However, we can’t always blame the franchisor for mistakes like this. Especially ones where the candidate is so obviously unsuited. In this case, I think the issue is one where Jenny did not seriously sit down and think about the printing business and what it takes to be successful. Either she didn’t do her research, or she has no concept of what she can or can’t do.

    If Jenny had done the research and completed an honest self-evaluation she would have never have even gotten to the stage of completing the initial application. Unfortunately, we live in an age where our failures are someone else’s fault and our successes are our own and Jenny is a perfect example of this thinking in action.

    Bottom line? In this case 90% Jenny’s fault and only 10% the franchisor’s fault.

    I’ve been asked time and again to post the following article that I’ve written about my own personal experience as a multi-unit franchisee where I succeeded at first, only to crash and burn later on. This article has been posted on several of my blogs, and picked up by numerous other blogs and online magazines. I believe it is appropriate to post here as well.

    I’m proud to say this article has been instrumental in helping a number of franchisees keep their doors open and work towards recovery. On the other hand, I’m also sad to say several businesses were not as fortunate, but at least the owners were able to exit with dignity and in few cases, with less liability than they previously thought possible. And, in one case, the owner actually exited in the black when we were able to facilitate the sale of her business when she previously thought about just walking away.

    Fear and Consequences of Failure

    I can personally relate to the trials and tribulations of owning franchise businesses as I have “been there and done that” and have experiences on both ends of the spectrum from achieving overwhelming success to dealing with bitter failure. I have definitely come to understand the fine line between success and failure in trying to nail down the American Dream.

    I know it is sometimes counterproductive to even mention failure which is why the subject is always avoided and never discussed. Yet, it’s out there and it’s real. Once franchisees face the possibility of failure and its very real consequences they can be motivated to understand that failure is not an option and commit 100% to a plan that addresses immediate problems and provides solutions accordingly. Even if it’s necessary for the plan to be quite drastic or aggressive due to prevailing circumstances, franchisees that unequivocally realize that failure is not an option are prepared for immediate action.

    Let me emphasize one point. Franchisees should not view poor sales and disappointing profits as either potential or immediate failure and stick their heads in the sand. I made that mistake in the past and suffered the consequences. Instead, franchisees should build upon the courage it took to become a franchise business owner and recommit to success as they did when they first took the entrepreneurial plunge.

    They need to remember their wishes, hopes and dreams that prompted the decision to own their own business? They need to remember the admiration of family and friends when they heard about the new venture? They need to remember the excitement when they actually signed the franchise agreement?

    Unfortunately, there’s a very distinct possibility the root of the problem is embedded in the franchisee’s actions, non-conformity to the franchise system and unwillingness to face reality. However, as there was some shining light evident during the franchise award process, it may not be a totally lost cause if the franchisee is made to completely understand the implications and consequences of failure.

    As franchisors are faced with the potential of closed units during this recession that may be the result of things out of their control, it’s imperative they don’t lose even a single unit just because a franchisee just flat out needs a snap back to reality. It’s worth the effort.

    Let me clarify something. I failed as a franchisee. Not because of anything the franchisor did or didn’t do but because I put and kept my head in the sand and did not face reality. I could go on and make excuses about things that happened around me but at the end of the day I could have turned things around if I got my own head out of the sand, made some difficult decisions and took full, immediate responsibility.

    Unfortunately I was scared of failing. I was afraid of what people would think. I was ashamed at what other franchisees, ones I put in business, would think of me. I couldn’t even think of facing my family. All lame excuses for not taking responsibility. Maybe a hard swift kick you-know-where would have helped.

    Did I mention that I previously ran the franchise company where I failed as a franchisee? Did I mention I was elected by fellow franchisees, President of the National Advisory Council? Did I mention that I owned and operated five franchise units?

    If I had clearly understood the implications and consequences that were looming on the horizon and if I was able to get my big ego out of the way and address things head on, maybe I could have survived. Maybe I could have at least implemented an exit strategy that would have, in some small way, paid back the loyalty and support of my employees, family and friends.

    In the end, I may not have survived because it may very well have been too late when and if I finally took action and responsibility. But maybe I could have at least exited
